• "Services & Products" include IT solutions, ERP, CRM, CMS, Admin Pane, Website, Portal, App, software development, digital marketing, eCommerce platforms, and other related services provided by Webkype

3. Use of Services & Products

• Users must be at least 18 years old to access our services.
• You agree to provide accurate, current, and complete information when using our services.
• Unauthorized use, duplication, resale, or distribution of Webkype’s products and services is strictly prohibited.
• Webkype reserves the right to suspend or terminate user accounts in case of violations of these terms.

• Webkype reserves the right to update or amend these terms as required, in accordance with any new agreements or contractual obligations.

5. User Responsibilities

Users ( Clients, Customer) are solely responsible for any content you upload, submit, or otherwise make available on the Service ("User Content"). You agree not to post User Content that is illegal, defamatory, or infringes on the rights of others. We reserve the right to remove any User Content that violates these Terms.

• Users must maintain the confidentiality of their account credentials.
• Users are responsible for all activities conducted under their account.
• Any misuse, hacking attempts, or unauthorized access to Webkype’s systems will lead to legal action.

6. Payment & Billing

All the payment will be collected only in below mentioned account only via NEFT, RTGS, IMPS, Cheque Deposit, Payoneer Services, Paypal or any other 3rd party service provider.

• All payments for Webkype services must be made as per the agreed terms
• Webkype reserves the right to modify pricing and payment structures with prior notice of billing.
• Late or non-payment may result in service suspension or termination.

7. Confidentiality & Data Protection

• Webkype ensures the confidentiality of user data as per our - Privacy Policy
• Users must not disclose sensitive business information obtained through Webkype without consent.
• Webkype implements industry-standard security measures to protect user data but cannot guarantee complete security against cyber threats.

8. Service Availability & Liability

Service Availability & Liability are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. the content, privacy policies, or practices of any third-party web sites or services. User acknowledge and agree that Webkype shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services

• Webkype strives to ensure continuous and secure service availability but does not guarantee 100% uptime.
• Webkype is not responsible for data loss, system downtimes, or disruptions caused by third-party service providers.
• Users agree that Webkype is not liable for any indirect, incidental, or consequential damages arising from the use of our services.

• Users may terminate their accounts by providing written notice as per our Cancellation Policy.( Refer Your Project Agreement)

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

12. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India, specifically under the jurisdiction of Uttar Pradesh, Noida.

• In the event of any dispute, both parties agree to first attempt to resolve the issue amicably through mutual discussions.
• If the dispute remains unresolved, it shall be referred to arbitration in Noida, Uttar Pradesh, India, in accordance with the provisions of the Arbitration and Conciliation Act, 1996.
• The arbitration proceedings shall be conducted in English.
• The decision of the arbitrator shall be final and binding on both parties.
• Subject to arbitration, courts located in Noida, Uttar Pradesh, India shall have exclusive jurisdiction over any disputes arising from these Terms and Conditions.
